This is a copy of my letter that I am sending to direct. I thought I would share it.

Dear DirecTV,
I am writing you to dispute my deactivation fee of $130.00 after reviewing my customer agreement I do not feel as if I should have to pay it. We had a number complains to DirectTv about my DVR not working but my biggest complaint was the customer service. You can review my record and see how many times I called in my last month of service alone. The customer service agents where very rude and blamed us for the device not working and at one point even called me a lair. At this point I decided that DirectTv had not lived up to their word of being #1 in customer service and could not fix the issues that I had called over and over so clearly DirectTv had breached their own term of agreement. As it clearly states in your customer agreement under the deactivation fee I should not have to pay because I did not miss a payment or breach my part of it.
(9) Deactivation Fee: If you cancel your Service or we deactivate your Service because of your failure to pay or for some other breach on your part, we may charge you a fee the lesser of (i) up to $15.00 ; or (ii) the maximum amount permitted by applicable law.
Because of the rude nature of the customer service I changed companies and for no other reason. I will not be talked to like that by a company that I am paying for a service. Since we have left DirecTV we have received an uncountable number of phone calls from you harassing us about coming back. If these calls continue I will be force to file a report with the law enforcement, FCC, and Better Business Bureau.
Thanks you and have a nice day.
